Texas DWI law increases penalties for adult DWI convictions, over 21 years of age, according to number of DWI offenses and other circumstances surrounding the arrest.
Having a minor under the age of fifteen years old in the vehicle, an open container, and/or causing injury or death to another person can all add penalties to the standard consequences for a DWI conviction in Texas.
It is also important to note that each charge stays on your record for life and can be used as a prior charge. The punishment below does not take into consideration any other factors that can elevate the crime class.
Punishment for First DWI Offense, Class B misdemeanor:
Fine up to $2,000
Jail time between 3 and 180 days
License suspension up to 2 years
DWI Surcharge up to $2,000 for 3 years to keep your drivers license
