Understanding that the vast majority of all Houston citizens avoid criminal activity entirely, it is important to have some understanding of what being charged with a crime actually means, in the event you are in this situation. It is a fair question. It is also a fairly common question anytime an individual is charged with a crime. Then the questions begin to multiply. How much time and effort will take to hire a defense lawyer, and how expensive is it going to be? Am I sure I need to hire a defense lawyer? Who knows how to begin the process of hiring an attorney? There are so many lawyers. How would I ever decide on which one?

Then the justifications start. I’m a nice person. I didn’t do this. I will just go into the court and tell the prosecutor my side of the story and they will understand. That is what they do in the movies and it always seems to work out. Right?

For a criminal case in Texas, the State has the highest burden of proof meaning the State’s burden is to prove the defendant is guilty beyond a reasonable doubt. The lowest burden of proof in our justice system is reasonable suspicion. Police officers need reasonable suspicion that a crime has been committed in order to detain a citizen. In order to arrest, a police officer needs probable cause.

The second highest burden of proof is used in family cases. This standard of proof is called clear and convincing evidence. Example; if the government wants to remove a child or terminate an individuals parental rights, the State of Texas must prove with clear and convincing evidence that the child is in danger.

Most juries would require a high degree of proof before they would be willing to declare that a parent was unfit to care for their child.

Texas DWI law increases penalties for adult DWI convictions, over 21 years of age, according to number of DWI offenses and other circumstances surrounding the arrest.

Having a minor under the age of fifteen years old in the vehicle, an open container, and/or causing injury or death to another person can all add penalties to the standard consequences for a DWI conviction in Texas.
